Letter to Peru President Vizcarra
Organizaciones de la sociedad civil piden al presidente Vizcarra luchar contra la impunidad y no dejarse engañar por empresa sentenciada por deforestar Tamshiyacu.
Civil society organizations ask Peru’s President Vizcarra to act against impunity and not be fooled by the company sentenced for deforesting Tamshiyacu.
National and international civil society organizations have asked the President of Peru to support the work of his Government agencies that have been investigating the illegal activities of the company Tamshi SAC in the Peruvian Amazon.
According to the letter, addressed to Martín Vizcarra, the Office of the Special Prosecutor for Environmental Matters (FEMA), the Environmental Assessment and Enforcement Agency (OEFA), the Ministry of the Environment, the Ministry of Agriculture and Irrigation, the Ombudsman's Office and the National Comptroller’s Office, are some of the State entities that have been investigating and even sanctioned said company. According to the organizations, "there is abundant evidence produced by the State itself, civil society organizations, academics and journalists, showing that Tamshi SAC (...) has deforested the Amazon forest and violated human and territorial rights of peasant families of Tamshiyacu and its surroundings." They recall that on July 25, 2019, the company Cacao del Perú Norte (today Tamshi S.A.C) and two workers were convicted of illegal trafficking of timber forest products and obstruction of enforcement procedures. The sentence issued by the Second Single-Person Criminal Courtof Maynas analyzed the illicit behaviors committed by the company officials, invalidating the fallacious arguments used by the defense, which even went so far as to deny the existence of forests, the application of the Forest Law and of Wild Fauna (Law No. 27308 in force as of 2013) and the need to have a previously approved environmental management instrument, which is clearly established in existing regulations.
